Smartphone App – Body composition & health tracking service
Article 1 (Application)
These Terms of Use (the "Terms") set forth the conditions for use of the smartphone application provided by the Company (including services that measure and record body weight and body composition data in conjunction with body composition scales and other devices; hereinafter referred to as the "App").
Users shall use the App only after agreeing to these Terms.
Article 2 (Definitions)
1. "User" means an individual who uses the App.
2. "Registration Information" means an ID, password, email address, and any other information designated by the Company that a User registers for use of the App.
3. "Body Composition Data" means data obtained from body composition scales and other devices or calculated by the App, including body weight, BMI, body fat percentage, lean body mass, and other body composition-related data.
4. "Linked Device" means a body composition scale or any other device that connects to the App via Bluetooth or other means.
Article 3 (User Registration)
Users shall complete user registration in the manner prescribed by the Company.
Users shall keep their Registration Information accurate and up to date.
The Company may refuse user registration or delete a registration if the Registration Information contains any false statement, error, or deficiency.
Article 4 (Management of ID and Password)
Users shall, at their own responsibility, strictly manage their ID and password and shall not allow any third party to use them.
If a User suffers damages due to unauthorized use of the User's ID or password, the Company shall not be liable, except where such damages are attributable to the Company's willful misconduct or negligence.
If a User suspects leakage or other compromise of the User's ID or password, the User shall promptly notify the Company and follow the Company's instructions.
Article 5 (Eligibility)
If a minor uses the App, the minor shall obtain the consent of a person with parental authority or other legal representative.
Users represent and warrant that they have the authority and capacity to agree to these Terms.
Article 6 (Grant of Permissions and Device Settings)
In order to use certain functions of the App (including connection with Linked Devices, data synchronization, QR code scanning, image attachment, and similar functions), Users must grant the permissions prescribed by the Company (including Bluetooth, nearby devices, camera, photos, storage, and similar permissions) in the device settings.
If a User refuses to grant such permissions, the relevant functions may not be available; however, other functions may remain available.
On Android devices, depending on OS specifications, location permission may be required to use Bluetooth functions. The Company may request such permission for the purpose of connecting to Linked Devices; however, if the Company obtains or uses location information, it shall do so in accordance with the Privacy Policy.
Article 7 (Prohibited Acts)
Using measurement results obtained from the App or Linked Devices as a basis for clinical diagnosis or any other medical practice.
Falsifying or tampering with measurement data, or unlawfully altering the operation of the App.
Analyzing the source code of the App or engaging in reverse engineering, decompilation, disassembly, or similar acts.
Collecting the App's data in bulk for commercial purposes, or scraping or similar acts without the Company's permission.
Using another person's account or impersonating a third party.
Registering or uploading another person's Body Composition Data or similar data without that person's consent.
Infringing the rights or interests of the Company or any third party.
Violating laws and regulations or public order and morals.
Any other act deemed inappropriate by the Company.
Article 8 (Handling of Data)
The Company shall handle Body Composition Data, Registration Information, and other information in accordance with the Privacy Policy.
The Company may use information that has been statistically processed, anonymized, or otherwise processed so that individuals cannot be identified, for purposes such as service improvement.
Article 9 (Intellectual Property Rights)
All copyrights, trademark rights, and any and all other intellectual property rights relating to the App belong to the Company or the legitimate right holders.
Article 10 (Medical Disclaimer)
Measurement results displayed by the App and Linked Devices are reference information for health management and do not constitute results of a medical device, nor do they guarantee diagnostic results or therapeutic effects.
If you experience poor physical condition or similar symptoms, please consult a medical institution and follow the judgment of a physician or other professional.
⚕️ Medical advisory: The App is not a medical device. Never rely solely on measurements for clinical diagnosis (see Prohibited Acts, Article 7).
Article 11 (Changes to and Termination of Service Content)
The Company may change the content of the App or suspend or terminate provision of the App as necessary.
In the event of a material change or termination of the service, the Company will notify Users in advance, except in emergencies.
Article 12 (Suspension of Use and Deletion of Registration)
If a User violates these Terms, the Company may, without prior notice, suspend the User's use of the App, delete the User's registration, and/or take other measures.
Article 13 (Disclaimer)
The Company makes no warranties regarding the completeness, accuracy, or fitness for a particular purpose of the App.
The Company shall not be liable for any loss, delay, or disappearance of data due to Bluetooth connection failures, device/OS/communication environment issues, malfunctions of Linked Devices, or similar causes, except where such loss is attributable to the Company's willful misconduct or gross negligence.
Except where damages are attributable to the Company's willful misconduct or gross negligence, the Company shall not be liable for any indirect damages, special damages, or loss of profits incurred by Users.
🔌 Technical disclaimer: Data loss due to Bluetooth / device issues is not the Company's responsibility unless caused by willful misconduct or gross negligence.
Article 14 (Notices)
Notices from the Company to Users shall be given by in-app display, sending to the registered email address, or any other method the Company deems appropriate. In the event of a material amendment to these Terms, the Company will provide advance notice by reasonable means.
Article 15 (Severability)
If any provision of these Terms is held invalid, the remaining provisions shall continue in full force and effect.
Article 16 (Exclusion of Anti-Social Forces)
Users represent and warrant that they do not fall under, and will not in the future fall under, any anti-social forces.
If a breach is discovered, the Company may suspend use and delete the registration without prior notice. Even if the User suffers damages as a result of such measures, the Company shall not be liable for any compensation.
Article 17 (Amendment of the Terms)
If amendment of these Terms conforms to the general interests of Users, or if it does not contravene the purpose of the contract and is reasonable, the Company may amend these Terms as necessary. The amended Terms shall be made known by posting within the App or on the Company's website or by other means, and shall apply from the time specified by the Company.
Article 18 (Governing Law and Jurisdiction)
These Terms shall be governed by the laws of Japan. Any and all disputes arising out of or in connection with the App shall be subject to the exclusive jurisdiction in the first instance of the Tokyo District Court or the Tokyo Summary Court.
